Five same-age peers sexually assaulted a 12-year-old male during a 5-to 20-minute break following a swimming activity. The counselor dropped the boys off at their cabin and told them to change clothes and get ready for lunch. He went to an adjacent cabin to change his own clothes. During his absence, two boys placed the victim in a headlock while a third tore off his underpants and threw him to the floor. The fourth youngster sexually assaulted him with a broomstick while the fifth boy kept watch for staff. When the counselor returned to the cabin to take the boys to lunch, the victim told what the other boys had done. The counselor took all the boys to lunch and told the camp supervisor. The camp supervisor notified the camp director and after lunch sent the victim to the camp nurse. The camp director called the police who arrived to complete an investigation.

Investigation confirmed that the assault had occurred. The police charged two of the youngsters who were later convicted of sexual assault. The victim's parents sued the camp for negligent supervision, asking for 28 million dollars in compensatory and punitive damages.
